Welcome to Growing Routes! By enrolling your child in a Growing Routes program, you agree to the following terms and conditions:
1. Intellectual Property Rights
All content, materials, logos, and media created or provided by the camp during camp sessions are the property of Growing Routes. This includes but is not limited to photographs, videos, written content, and any other creative work produced during camp activities. Campers or their parents/guardians may not use, reproduce, distribute, or modify these materials without written permission from Growing Routes.
2. Limitation of Liability
By enrolling in Growing Routes, parents and/or legal guardians of the minor named below ("Participant") acknowledge and agree that any use of Growing Routes’ facilities, services, tools, equipment, and premises, as well as premises owned by others being used by Growing Routes (hereinafter collectively referred to as the "Facilities"), and any participation in Growing Routes programs and activities ("Programs"), involves inherent risks, both known and unknown. These risks include, but are not limited to:
Moderate and severe personal injury.
Temporary or permanent disability.
Sickness or disease, including but not limited to COVID-19.
Death.
Property damage.
Programs may include, but are not limited to, activities such as hiking, camping, mountain climbing, swimming, boating, walking/running in the woods, moving about a Growing Routes venue or activity destination, preparing and cooking food, using an open fire pit, yoga, sports, and other physical activities, as well as working with tools, equipment, and materials used to make arts and crafts.
Participants will be engaging in Programs with Growing Routes employees, contract workers, volunteers, members, directors, officers, agents, guests, insurers, successors, and/or other associates, as well as with Chloë Rowse, her family members or guests, the signer/author(s) of the Camp Standing Orders, and the owner(s) of the premises used for Programs (hereinafter collectively referred to as the “Growing Routes Staff”). Participation in Programs may also involve travel to and from Programs and Facilities in vehicles driven by Growing Routes Staff.
Parents/guardians voluntarily accept and assume full responsibility for these risks, as well as any and all other risks arising out of or in any way related to the use of Facilities and participation in Programs.
3. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The unenforceable provision will be replaced with a valid provision that closely approximates the intent and economic effect of the original provision.
4. Governing Law & Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of the state of Maine. Any disputes arising from the application of these terms shall be subject to the exclusive jurisdiction of the courts in Maine.
5. Child Protection
The safety and well-being of children are our top priorities. Growing Routes has implemented strict safeguarding procedures, including background checks on all staff and volunteers, regular training on child protection issues, and clear policies for reporting and responding to any suspected abuse or neglect. We are committed to creating a safe environment where all children are treated with respect and care.
6. Lost Property
Campers are responsible for their personal belongings. Growing Routes is not responsible for lost, stolen, or damaged items. Parents/guardians should ensure that their child’s name is clearly marked on all personal items. Any items left behind at the end of camp will be held for 14 days, after which unclaimed items will be donated or discarded.
7. COPPA (Children's Online Privacy Protection Act)
In compliance with COPPA, Growing Routes does not knowingly collect personal information from children under the age of 13 without verifiable parental consent. Any data collected for the purpose of enrollment, camper records, or communication with parents will be handled in accordance with our Privacy Policy. Parents have the right to review and delete their child’s information upon request.
8. Privacy Policy
Growing Routes is committed to protecting your privacy. We collect and use personal information (such as names, contact details, health information, etc.) solely for camp operations and communications. We will never sell or share your information with third parties without your consent unless required by law.
9. Waiver, Release, Indemnification & Covenant Not to Sue
In consideration of, and as a condition for, Participant’s participation in Growing Routes Programs, the parent and/or legal guardian of Participant acknowledges and agrees that Growing Routes, its officers, members, directors, agents, employees, volunteers, insurers, successors, representatives, Chloë Rowse, her family members or guests, the signer/author(s) of the Camp Standing Orders, and the owner(s) of the premises used for Programs or activities in Falmouth, Wilton, and Bremen, Maine (collectively referred to as "Releasees") will not be liable for any personal injury, property damage or loss, disability, death, sickness, or disease incurred by Participant, the parent/guardian, their family members, dependents, or guests, however occurring, including but not limited to the negligence of Releasees.
The parent/guardian understands that they will be solely responsible for any loss or damage, including personal injury, property damage, disability, death, sickness, or disease arising from the use of Facilities and participation in Programs.
Furthermore, on behalf of Participant, themselves, and any and all legal successors and proxies, the parent/guardian releases and hereby agrees to waive and covenant not to sue Releasees from any causes of action, claims, suits, liabilities, or demands of any nature whatsoever, including but not limited to claims of negligence. This waiver applies to any potential future claims arising from personal injury, property damage, disability, death, sickness, disease, or accident of any kind, related to the use of Facilities or participation in Programs, whether supervised or unsupervised, and regardless of how the injury or damage occurs, including through the negligence of Releasees or actions or inactions of other participants.
In further consideration of Participant’s use of Facilities and participation in Programs, the parent/guardian agrees to indemnify and hold harmless Releasees from and against any and all causes of action, claims, demands, suits, liabilities, costs, or expenses (including reasonable attorneys’ fees) of any nature whatsoever, including claims of negligence, arising out of or in any way related to the parent/guardian’s or Participant’s use of Facilities or participation in Programs.
The parent/guardian also warrants and represents that (1) they are the legal parent and/or guardian of Participant; and (2) the decision for Participant to attend Programs has been made voluntarily, despite the aforementioned risks, without reliance on any representations, statements, assurances, or commitments, whether oral or written, by Growing Routes Staff or anyone else.
10. Cancellation Policy
Partial refunds, less the non refundable registration fee, will be considered on a case by case basis ONLY if the full registration fee was paid on time and camper withdraws at least eight weeks (56 days) prior to the first day of camp. Notice must be provided in writing via email AND confirmed via a phone conversation with the Growing Routes Camp Director.
Refunds for withdrawals less than eight weeks before the start of camp are not provided but exceptions will be evaluated by the Growing Routes Director on a case by case basis.
Positive Covid 19 Test: A withdrawal within seven days of the start of camp due to a positive Covid-19 test will be refunded on a case by case basis up to 25% of the balance of the registration fee, not including the non-refundable deposit.
Absence: No refunds are permitted for any absence during camp, including due to minor illness/injury, quarantine, family schedule changes, forgotten registrations, behavioral concerns, etc. Growing Routes reserves the right to ask a camper to not attend camp if certain circumstances present.
Family Emergency: In the event of a serious illness/injury or family emergency, Growing Routes will evaluate eligibility for a partial refund of the balance of the registration fee (not including non-refundable deposit) on a case-by-case basis.
Camp Cancelation: If Growing Routes must cancel camp for any reason, a full refund less the non refundable deposit, will be offered.
11. Discrimination Policy
It is Growing Routes policy not to discriminate on the basis of race, color, religion, national origin, gender identity or expression, age, sexual orientation or disability. We believe there is no place for racist or biased language, attitudes, behavior or actions in our operations and programs.
By enrolling your child in a Growing Routes Program, you acknowledge that you have read, understood, and agreed to these terms and conditions.
